At a regular meeting of the Board of Trustees of the Village of Schuylerville, Saratoga County in the State of New York, held on Monday May 5th, 2024 at 35 Spring Street, Schuylerville, NY 12871, the following resolution was passed.

Local Law No. 1 of 2024

 

Local Law of the Village of Schuylerville authorizing the use of Video Conferencing for Meetings of the Village of Schuylerville Board of Trustees in the event of “extraordinary circumstances.”

 

Section 1. Legislative Intent:

 

It is the intent of this local law to give Village Board members the authority to participate in Village Board meetings via videoconference in the event of “extraordinary circumstances” preventing the physical attendance of a Board Member.

 

Section 2.  Authority:

This Local Law is authorized by Chapter 56 of the Laws of 2022 of New York, which amends the New York Open Meeting Law, Section 103-a, to allow for the expanded use of video-conferencing in circumstances where there are “extraordinary circumstances”

 

Section 3.  Title and Body:

Local Law No. 1 of 2024 shall be known and cited as the “Videoconferencing for the Conduct of Village Board Meetings” and a new chapter, Chapter 47, shall be added to the Code of the Village of Schuylerville, which shall read as follows:

Chapter 47, Article IV – 1.  Authorization:

The Board of Trustees of the Village of Schuylerville is authorized to use videoconferencing technology to conduct their meetings in accordance with the provisions of Section 103-a of the New York Public Officers Law, subject to the following conditions set forth in Chapter 47, Article – 3 below.

Chapter 47, Article IV – 2.  As used in this Chapter, the following terms shall have the meanings indicated:

MEETING: a gathering of the members of the Board of Trustees of the Village of Schuylerville for the transaction of official business, for which a quorum of its members must be present.

MEMBER:  a duly elected member of the Board of Trustees of the Village of Schuylerville

PHYSICAL PRESENCE: where a member is physically present at the meeting location.

QUORUM: a majority of the members of the Village Board.

VIRTUAL PRESENCE: when a member or members participate in a public meeting virtually, using video conferencing.

Chapter 47, Article IV – 3.  Requirements for the use of Video Conferencing:  Whenever video conferencing is utilized to conduct a public meeting of the Village Board, the following conditions must be met:

A.    A minimum number of the Members of the Village Board sufficient to fulfill the Village Board’s quorum requirement must be present in the same physical location where the public can attend;

 

  1. Members of the Village Board shall be physically present at a Meeting of the Village Board unless such Member is unable to be physically present due to extraordinary circumstances including, but not limited to: disability, illness, care giving responsibilities, military service, or any other significant or unexpected factor or event which precludes the member’s physical attendance at such meeting.

 

  1. A Member who wishes to participate in a meeting by videoconference must provide advance notice and justification for their absence to the extent possible to the Village Mayor or Deputy Mayor in the absence of the Mayor.

 

  1. The Village Mayor or Deputy Mayor, if applicable, may require a Member requesting to participate by videoconference to provide documentation, to the extent possible, support such request and may publicly confirm that such documentation was received without publicly stating the contents of such documentation.

 

  1. Except in the case of executive session, the Village Board shall ensure that Members who are participating remotely can be heard, seen, and identified at all times while the meeting is being conducted.

 

  1. The minutes of the meetings involving participation by a Member by videoconferencing shall state which members participated by videoconference, and shall be available to the public.

 

  1. If videoconferencing is being used to conduct a meeting, the public notice for the meeting shall inform the public that videoconferencing will be used, where the public can view and/or participate in such meeting, where required documents and record will be posted or available, and identify the physical location for the meeting where the public can attend.

  1. If videoconferencing is being used to conduct a meeting, the public body shall provide the opportunity for members of the public to view such meeting via video, and to participate in proceedings via videoconferencing in real time where public comment or participation is authorized and shall ensure that

videoconferencing authorizes the same public participation as in-person participation.

 

  1. Any and all videoconferencing technology used for public meetings shall be made accessible to members of the Village Board and the public with disabilities in accordance with the Americans with Disabilities Act of 1990, as amended.

Section 4.  Severability:

If any provision of this Local law is determined to be unconstitutional or invalid, the validity and enforceability of the remainder shall not be affected.

Section 5.  Effective Date:

This Local law shall take effect immediately upon filing with the Secretary of State.

Be it enacted by the Village of Schuylerville Board of Trustee, County of Saratoga, State of New York as follows:

Section 1.  Title:

 Local Law No. 1 of 2023 is entitled “Local Law Amending the Village Code §151-19 with respect to seasonal parking.”

Section 2.  Legislative Intent:

It is the intent of this Local Law to define seasonal parking on the streets and roads located within the Village of Schuylerville to ensure safety and efficient maintenance of the streets and roadways during the winter months and to facilitate efficient and cost-effective snow removal operations.

Section 3.  Authority:

 This Local Law is adopted pursuant to Municipal Home Rule Law Section 10, and Village Code Section 1-7.

Section 4.  Body of Local Law No. 1 of 2023:

 151-19 Seasonal Alternate-side parking, is amended as follows:

 Notwithstanding any other provision of this chapter, beginning December 1 of each year and continuing through March 31 of the following year, except as may be provided in Schedule XV hereof, on-street parking within the Village of Schuylerville shall be as follows:

  1. Streets running north and south; Broad Street:
  • For streets running north and south, except for Broad Street, parking shall only be permitted on the east/even side of such streets on Tuesday, Thursday, Saturday and Sunday from 8:00 a.m. to the following day at 8:00 a.m.; and parking shall only be permitted on the west/odd side of such streets on Monday, Wednesday and Friday from 8:00 a.m. to the following day at 8:00 a.m. Parking on such streets at other times is prohibited.
  • For Broad Street, parking is permitted each day from 6:00 a.m. to 11:59 p.m. the same day. Parking is prohibited at all other times, which includes each day between the hours 12:00 a.m. to 6:00 a.m.

  1. Streets running east and west; Ferry Street:
  • For streets running east and west, except the section of Ferry Street (State Route 29) that is east of Broad Street, parking shall only be permitted on the south/odd side of such streets on Tuesday, Thursday, Saturday and Sunday from 8:00 a.m. to the following day at 8:00 a.m.; and parking shall only be permitted on the north/even side of such streets on Monday, Wednesday and Friday from 8:00 a.m. to the following day at 8:00 a.m. Parking on such streets at other times is prohibited.
  • For Ferry Street (State Route 29) located east of Broad Street, parking is permitted each day from 6:00 a.m. to 11:59 p.m. the same day. Parking is prohibited at all other times, which includes each day between the hours of 12:00 a.m. to 6:00 a.m.

Section 5.  Severability:

If any provision of this Local law is determined to be unconstitutional or invalid, the validity and enforceability of the remainder shall not be affected. 

Section 6.  Effective Date:

This Local law shall take effect immediately on December 1, 2023

2023 local Law 1 resolution parking

Due to the concerns for Public Safety of the residents of the Village, the following local law passed in 1992, is posted:

Burning: Outdoor*

*Adopted by the Board of Trustees of the Village of Schuylerville 8-10-1992. Amendments noted where applicable.

Legislative Intent. The intent is to prohibit open burning within the Village of Schuylerville limits. the open burning of garbage, rubbish, brush, etc., is an unsafe practice and creates an unhealthy environment for the residents of the community.

Prohibited burning. No person shall burn, allow or permit to be burned by open fire, on the ground or in any container, any brush, garbage, rubbish, plastic, tires, chemicals, leaves, wood, paper or any other materials that will produce smoke and/or odors.

Use of Outdoor Grills. The safe operation of gas and charcoal grills and the use of outdoor fireplaces for the preparation of food shall not be prohibited.

Restricted burning. The Village Board may authorize the Public Works Dept. or the Fire Department to burn structures, lumber, brush, or other items, provided that all necessary permits required by the Health Dept. or New York State Dept. of Environmental Conservation are obtained.

Penalties for offenses. Any person convicted of violating any provision of this chapter shall be guilty of a violation punishable by a fine of not more than two hundred fifty dollars ($250.) or imprisonment for a period of not more than fifteen (15) days, or by both fine and imprisonment. The continued violation of this chapter shall constitute, for each day the offense is continued, a separate and distinct violation.
